Can You Travel on H-1B This Winter? (Quick Answer)
Often yes. A valid H-1B stamp does not have to name your current employer. The State Department's Foreign Affairs Manual (9 FAM 402.10-11) lets a worker re-enter on the original stamp with the new I-797, or with a dated filing receipt while a transfer is pending.
The main exception is a pending change of status from F-1/OPT or H-4 to H-1B, which USCIS treats as abandoned if you leave. Otherwise the stamp only has to be valid on the day you land, and CBP decides on admission and length of stay.
- Old employer's stamp, new petition approved: the old stamp plus the new I-797.
- Transfer filed, not yet approved: the old stamp plus a dated filing receipt.
- Extension pending: if your status ends during the trip, the return waits for the approval.
- Stamp expires before you land: a new stamp is needed, apart from short revalidation trips to Canada or Mexico.
According to the USCIS H-1B page, updated 21 September 2026, the $100,000 proclamation of 2025 does not apply to currently valid H-1B visas or stop their holders from travelling in and out. Nothing here guarantees admission.
Old Stamp From a Previous Employer and a New I-797
According to applicant reports on Reddit in October 2026, workers ask about stamps from a previous employer, some expiring soon, and one issued for a company that has since been acquired.
Under 9 FAM 402.10-8(A), a change in employment does not affect a currently valid H-1B visa. Under 9 FAM 402.10-11(A), a worker who changed employers under USCIS procedures may keep using the original visa and, once the new petition is approved, presents the new Form I-797 with it. The employer name on the stamp is not, by itself, a reason to re-stamp.
At the airport, the inspecting CBP officer still decides (8 CFR 235.1(f)).
After an acquisition or merger
Under 9 FAM 402.10-7(F), the petition stays valid if the new company took over the original employer's interests and obligations and the job terms are unchanged apart from the employer's identity. Whether that holds is for the employer's counsel to confirm. We found no official CBP document list for this case and suggest carrying an employer letter that confirms the successor relationship.
Travelling While a Transfer, Amendment or Extension Is Pending
According to applicant reports on Reddit in October 2026, many workers plan short trips during a pending amendment, extension or transfer.
Transfer to a new employer
Under 8 CFR 214.2(h)(2)(i)(D), the new employer's petition asks for classification and an extension of your stay, so a transfer is an extension-of-stay filing, not a change of status.
For re-entry while it is pending, 9 FAM 402.10-11(A) asks for a dated filing receipt or other evidence of timely filing alongside the visa. One poster believed the physical I-797 has to arrive before departure, which is the poster's assumption, not the manual's rule. If the new petition is denied, the new job has to stop.
We found no official answer for returning during a pending transfer after the old employer has withdrawn its petition, so we recommend settling that with the attorney before booking.
Extension or amendment with the same employer
Under 9 FAM 402.10-12, a worker who leaves while an extension is pending may apply for a visa abroad, but it cannot be issued until the approval appears in the State Department's petition system. A USCIS FAQ page, now archived and marked as out of date, says departure generally is not a reason to deny the extension.
The real risk is the calendar. If your status ends while you are abroad and the petition is still pending, international offices such as Yale's say you cannot return until it is approved, possibly with a new stamp as well. For an amendment that does not extend your stay, ask the attorney which approval you will travel on.
Premium processing and RFEs
According to a USCIS page updated 23 March 2026, premium processing means action within 15 business days, which can be an approval, an RFE or a denial. An RFE stops the clock, and a new 15-business-day period starts when USCIS receives the response.
Change of status to H-1B or H-4
USCIS says leaving while a change of status to H-1B is pending abandons it. The approval then works as a consular notification, and you would generally need an H-1B stamp before returning. The USCIS Travel Documents page, updated 21 August 2026, says leaving generally abandons an I-539 such as an H-4 change of status, and advance parole does not prevent it.
After a change of status there is no H-1B stamp in the passport, a point raised in applicant reports on Reddit in October 2026 about weekend trips to Canada. Our guide to Canada and Mexico travel with an expired H-1B stamp explains when revalidation can help.
When Your Stamp Expires During the Trip
According to applicant reports on Reddit in October 2026, one worker will be in India from 22 October to 11 November, with a stamp valid to 18 November and a new same-employer I-797 starting 19 November. The question is whether the I-94 will stop at 18 November or run to 2029.
- The stamp. Under 22 CFR 41.112(a), visa validity is only the window for applying for admission and has no relation to the length of stay. Landing by the expiry date is what counts. Without a valid visa at that moment, INA 212(a)(7)(B)(i) makes a nonimmigrant inadmissible.
- The I-94. Under 8 CFR 214.1(l)(1), admission covers the petition validity plus up to 10 days before and after it. The words "up to" mean those days are not automatic.
We found no official CBP or USCIS text on which of two back-to-back approvals sets the new I-94, so this article does not predict the date. We suggest carrying both I-797 notices, as international offices such as Yale's typically advise, checking the I-94 online on the day you land and using a CBP deferred inspection site if it is wrong. Our separate article on an I-94 that is shorter than the I-797 covers this in depth.
If the stamp has already expired
Then a trip to India means re-stamping before the flight back. Under 9 FAM 402.10-11, an H-1B visa can be issued up to 90 days before employment starts but used only from 10 days before the approved status period. If the old visa and petition have expired and the new approval is still pending, no visa can be issued yet.
Automatic visa revalidation under 22 CFR 41.112(d) covers only absences of 30 days or less spent solely in Canada or Mexico, so a trip to India never qualifies.
Documents to Carry for Re-entry
We found no official CBP or State Department checklist for H-1B re-entry.
Named in the rules
- A passport valid for at least six months beyond the intended stay, unless another rule provides otherwise (8 CFR 214.1(a)(3)(i)).
- The old passport if your valid stamp is in it, plus a valid current passport (22 CFR 41.112(b)(3)).
- A valid H-1B stamp, even one that names a previous employer.
- The new Form I-797, or a dated filing receipt while the new petition is pending (9 FAM 402.10-11(A)).
Commonly recommended
- Pay slips for the last three months, which international offices such as Yale's typically advise.
- Both the current and the new approval notices if an extension is approved before the current petition ends.
- An employment letter, and after an acquisition, a successor letter from the employer's counsel.
These extras are not CBP requirements. University guidance also warns that CBP may admit you only until the passport expiration date.
What CBP Checks and How Your I-94 Is Set
At the airport, the officer checks your documents and decides whether you are entitled to enter (8 CFR 235.1(f)). The stay is set at entry from the petition validity plus up to 10 days on each side.
According to applicant reports on Reddit in October 2026, one worker sent to secondary inspection in Chicago last October is nervous about a late-December trip. Secondary inspection can happen to anyone and is part of normal admission. In CBP's newsroom releases from 15 to 20 October 2026, we found no announced change for H-1B travellers or for the 3 November midterms.
Reading your I-94
- CBP's I-94 fact sheet says the Admit Until Date is the date your status expires. For H-1B it is a hard end date.
- CBP's I-94 page, last modified 22 July 2026, points travellers to the I-94 website or the CBP Link app and its "Get Most Recent I-94" option.
- CBP deferred inspection sites handle arrival documents that need review or correction.
- Form I-797A carries a replacement I-94. After a trip abroad, check the I-94 issued at your most recent entry.
Stamping Appointments in India in December
The State Department's wait-time forecast dated 21 October 2026 showed the following next available appointment for petition-based visas (H, L, O, P, Q). These figures are forecasts, not a guarantee, and they change with each update, so check the live table before planning.
- New Delhi: 3.5 months
- Mumbai: 2 months
- Chennai: 2.5 months
- Hyderabad: 6.5 months
- Kolkata: 1 month
What else affects a December booking
- Interviews. Since October 2025, H-1B renewals generally need an in-person interview, according to a State Department update we could not re-open on 22 October. As a medical accommodation, the US Mission in India waives interviews only in extreme situations, such as needing an air ambulance.
- Booking. The Mission's visa page, updated 13 October 2026, asks applicants to book in their country of residence or nationality. H-1B and H-4 applicants are told to set social media accounts to public.
- Expedite. Requests go through the Mission's online appointment system and only after a regular appointment is confirmed, and slots are very limited. A State Department page we could not re-open on 22 October says weddings do not qualify.
- Closures. Consular sections across India are closed to visa applicants on 28 October, 18 November and 16 December 2026. Chennai's 2026 list also shows 26 November and 25 December, so check your own post for US holidays.
An approved petition counts as prima facie evidence, but under 9 FAM 402.10-9(A) the applicant still has to establish visa eligibility at the interview.
Visarun is a visa agency, not a government office. We help prepare and check the DS-160 and stamping documents, while slots, the visa decision and admission belong to the consulate and CBP, and we cannot guarantee them. Without any valid stamp, see our guide to H-1B stamping appointments in India.
Recent Changes (2025-2026)
- $100,000 payment. The USCIS H-1B page, updated 21 September 2026, says the 2025 proclamation does not apply to currently valid H-1B visas and does not prevent their holders from travelling in and out.
- Petitions inside the US. For petitions filed on or after 21 September 2025, the same page says the payment does not cover an amendment, extension or change of status granted inside the US. It applies if USCIS finds the person ineligible, or if the person leaves before a change of status request is decided.
- Court order. A federal court vacated the agency guidance implementing the payment on 8 June 2026, and the First Circuit denied a stay on 24 July 2026. According to USCIS, DHS is complying and still plans to collect the payment if the order is lifted.
- Extension to 2027. Proclamation 11069, signed on 18 September 2026, extends the restriction by 12 months, to 21 September 2027. Its section 3(a) adds people who need to seek admission to put a petition approval into effect, including through consular notification.
- No agency guidance yet. As of 22 October 2026, we found no USCIS or State Department guidance on the extension. Its effect on people who leave during a pending transfer or change of status has not been addressed, and this article draws no conclusion for individual cases.
- Layoffs. An executive order of 18 September 2026 directs agencies to take into account, in H-1B petitions, visas and entry, whether the employer had layoffs in the previous year or plans them. We found no CBP guidance on how this applies at the airport.
FAQ
Do I need a new H-1B stamp after changing employers?
Not because of the employer change alone. Under 9 FAM 402.10-8(A) and 402.10-11(A), a valid stamp stays usable together with the new I-797, and the CBP officer at the airport makes the admission decision.
Can I travel while my H-1B transfer is pending?
The State Department's manual asks for the visa plus a dated filing receipt. If your status ends while you are abroad and the petition is still pending, the return waits for the approval and possibly a new stamp.
What happens if I leave during a pending change of status to H-1B?
USCIS treats it as abandoned, and you would generally need an H-1B stamp from a consulate. USCIS links the $100,000 payment to this case. A court vacated that guidance in June 2026, but Proclamation 11069 covers consular notification.
My stamp expires while I am in India. Can I return on it?
Only if you land on or before the expiry date. If it has expired by then, you would generally need a new stamp before flying back.
Will CBP give me an I-94 to the end of my new I-797?
We found no official text on how CBP handles two back-to-back approvals. We suggest carrying both notices and checking the I-94 online on the day you land.
Is the 10-day grace period automatic?
No. The regulation allows admission for the petition validity plus up to 10 days before and after it. Your I-94 shows what CBP actually granted.
Does the $100,000 fee affect travel on a valid H-1B visa?
USCIS said on 21 September 2026 that the proclamation does not apply to currently valid H-1B visas or stop their holders from travelling. We found no agency guidance on the September 2026 extension as of 22 October 2026.
Can I get an emergency appointment for a December wedding in India?
According to a State Department page we could not re-open on 22 October, weddings do not qualify for an expedited appointment. Expedite requests also need a confirmed regular appointment first.
