Your Travel Date Passed and the Visa Is Still Pending (Quick Answer)
A pending Schengen application does not lapse when the flight date goes by. Under Article 23(4) of the EU Visa Code, the consulate still has to take a decision unless you withdraw the application. It either issues a visa or refuses.
The refusal grounds in Article 32(1) do not list travel dates that passed during processing. We found no rule that turns a late file into an automatic approval or refusal once day 45 has passed.
Three situations
- Still pending and you still want to go: wait, track the file through the visa centre and answer any document request fast. VFS pages for the Netherlands tell applicants to contact VFS if nothing has been heard after 45 days.
- The trip is off: withdraw in writing through the visa centre or the mission, and expect no fee refund once processing has started.
- The visa arrives for dates already gone: it works only inside the dates printed on the sticker. The Netherlands does not move visa dates for trips postponed by slow processing, and the applicant can apply again.
Official Decision Times - 15 Days, Extensions to 45
Article 23 gives consulates 15 calendar days from the lodging of an admissible application. In individual cases that need further scrutiny, this can be extended to a maximum of 45 calendar days. These are calendar days, not working days, and Article 23(2a) lets urgent cases be decided without delay.
The Commission's Visa Code Handbook, which is official guidance rather than law, says the clock runs from the moment the consulate finds the file admissible, not from your VFS, TLS or BLS appointment. You may not be told that date, so day 45 is hard to pin down. German missions in India, for example, say a file can take up to 6 working days just to reach the consulate.
Published times (as of October 2026)
- Italy, Consulate General in London: up to 45 days, 15 days at the minimum, and processing cannot be rushed.
- Spain, BLS centre in Manchester: the centre's own estimate is "6-8 weeks", whose upper end goes beyond the 45-day legal maximum.
- Belgium, Embassy in the UAE: two to three weeks, plus about two more for nationalities under a Schengen-wide security check.
According to applicant reports on Reddit in October 2026, some Spain files lodged through BLS in the UK over the summer were still waiting after 60 to 70 days. We recommend checking your mission's official page before planning around any figure.
When the Consulate Asks for New Bookings
Article 21(8) lets consulates request additional documents in justified cases. According to applicant reports on Reddit in October 2026, one applicant gave biometrics for Italy in London on 3 September for a 1 to 4 October trip and on 19 October was asked for new flight tickets, updated bank statements and a hotel confirmation.
- Flights: the Handbook says a paid ticket should not be required at lodging, but checklists differ by mission. The EU list for UK applicants asks for "proof of reserved return ticket", while BLS Manchester for Spain wants tickets issued by the carrier.
- Hotels: the Handbook calls a hotel reservation weak proof of purpose, since it can be cancelled free of charge.
Article 9(1) says applications are lodged no more than six months before the trip, so we recommend asking the consulate in writing whether much later dates are acceptable before paying for anything. Some missions are strict about changes. Czech guidance from 2023 says unreported changes to bookings lead to annulment or revocation, which is Czech practice and not an EU rule.
Withdrawing an Application and Getting Your Passport Back
No single EU rule covers withdrawal or taking the passport back mid-process. Some missions lend the passport out for emergencies, while others expect you to cancel the application. VFS says such requests go through the country-specific site or helpline.
Examples by mission (as of October 2026)
- Denmark, London: applicants email the embassy with the ApplyVisa ID, name and passport number. Cancellation is final, and the fee is refunded only if processing has not started. A temporary passport withdrawal is possible for an urgent reason.
- Spain, Manchester via BLS: a cancellation form closes the procedure with no appeal, and all fees are non-refundable.
- Italy, London: the passport is not released during processing. The page does not explain withdrawing the whole application, so it is worth asking in writing.
- Germany, India: if you plan to travel within 15 calendar days of the file reaching the visa section, the passport and unprocessed file come back with a fee refund.
- Germany, Bahrain: withdrawal takes a signed letter, and the passport stays until processing ends unless you cancel.
- Belgium, UAE: the passport is released only for documented emergency travel, with proof and a paid ticket.
Article 16(7) makes the visa fee non-refundable unless the file was inadmissible or the consulate was not competent. A new application means a new fee, EUR 90 for applicants aged 12 and over as of October 2026.
We found no official return time for BLS Spain. According to applicant reports on Reddit in October 2026, one Manchester applicant got the passport four working days after the cancellation form, while another was still waiting after more than two weeks.
Visa Shorter Than Your Trip - Why It Happens and What You Can Do
The sticker sets three limits: validity (the FROM and UNTIL window for entering and leaving), the number of days you may stay inside that window (the duration of stay), and the number of entries. Article 24(1) bases validity and stay on the examination of the application, and a single-entry visa normally adds 15 days of grace to the validity, not to the stay.
Why it happens
The Handbook says the stay should in principle match the purpose of the trip. It recommends that consulates add a few days for cancellations or illness, but that is best practice, not a duty. According to applicant reports on Reddit in October 2026, the most discussed case was a 16-day stay granted for a non-refundable trip entering Budapest on 21 November and leaving Prague on 7 December.
Count both days
Under Article 6(2) of the Schengen Borders Code, the entry day and the exit day both count, so 21 November to 7 December is 17 days. Staying past the duration of stay is an overstay even inside the validity window, and since 10 April 2026 the Entry/Exit System detects overstays automatically.
Can it be appealed?
EU law guarantees an appeal only against a refusal (Article 32(3)) or an annulment or revocation (Article 34(7)). A visa granted for fewer days is none of these. We found no country page, the Dutch immigration service's objection page included, that offers a route against a short visa.
What you can do
- Rebook the return flight so the trip fits the granted days.
- If the sticker does not match the itinerary you submitted, write to the issuing mission at once. The Netherlands corrects dates that are wrong.
- Apply for a new visa. It has to complement the current one, as two uniform visas cannot cover the same period.
- An Article 33 extension is requested from inside the Schengen area. It is free for force majeure or humanitarian reasons and discretionary, at EUR 30, for serious personal reasons, so it is not a fix for a booking longer than the visa.
Visa Starts the Day You Land - Overnight Flights and Airline Checks
Under Article 6(1)(b) of the Schengen Borders Code, a valid visa is an entry condition, checked at the border on entry. Entry happens at passport control in the first Schengen airport where a flight from outside lands, including a hub where you change to an internal flight. So an overnight flight that lands on or after the visa start date matches the legal rule, although we found no airline or government text that says so outright.
Airlines are cautious for a reason. Under Directive 2001/51/EC, states fine carriers that bring passengers without the required documents, either per person (a maximum of at least EUR 5,000 or a minimum of at least EUR 3,000) or as a lump sum per infringement. The carrier also has to take back anyone refused entry.
According to applicant reports on Reddit in October 2026, cases include a Norway visa valid from 16 December with a flight leaving Vietnam at 22:00 on 15 December, and check-in staff in Hyderabad misapplying visa rules to a couple.
- When applying, give the date you actually land as the arrival date.
- Carry the itinerary that shows the arrival time, and ask the airline in writing before the flight.
Planning Buffers for Christmas Trips
Article 9(1) sets the window at no more than six months and, as a rule, no less than 15 calendar days before the trip. The Handbook says late applicants should be warned that the decision may come after departure. According to applicant reports on Reddit in October 2026, one Switzerland applicant lodged 12 days before travel and still had no update two days before the flight.
Missions also close over the holidays. In one example from last season, the Danish Embassy in Indonesia shut its visa section from 24 December 2025 to 1 January 2026. We found no 2026 notices for UK, Indian or Gulf missions, so it is worth checking your mission's page in November.
Our advice, not an official figure, is to lodge 6 to 8 weeks before a late-December trip, and earlier where a consulate has a backlog. For 20 December that means roughly 25 October to 8 November 2026. Where the checklist allows reservations, hold off on non-refundable tickets until the visa is in hand.
Recent Changes (2025-2026)
- EES: fully operational since 10 April 2026, after a start on 12 October 2025.
- Germany: remonstration against refusals ended on 1 July 2025, so refusals now go to the Administrative Court in Berlin.
- Commission data for 2025: over 12 million applications, a 14.6% refusal rate, and India third with 1.15 million.
- Fee: EUR 90 for applicants aged 12 and over, unchanged since 11 June 2024.
- Visa Code revision: according to VisasNews, the Commission opened a consultation in September 2026, with a proposal expected in early 2027. Nothing changes for current applicants.
FAQ
Will my visa be refused because my travel dates have passed?
The Visa Code does not list passed travel dates as a refusal ground. A consulate can still refuse if the purpose of the stay is not justified, so it helps to answer any request for new bookings quickly.
Can the consulate move my visa to new dates?
The only official answer we found is Dutch. The Netherlands corrects only dates that are wrong, and for a trip postponed by slow processing the applicant applies again.
Do I have to use a visa that arrived too late?
No EU text we read obliges you to travel. You can ask in writing for the visa to be revoked under Article 34(3), and no appeal follows.
Will an unused visa hurt my next application?
The Handbook says cancelled bookings alone do not justify revoking a visa. BLS Edinburgh for Spain, however, warns that cancelled bookings may lead to future refusals, so we recommend keeping proof of why you did not travel.
Does an unused visa count towards the cascade?
The cascade counts visas "obtained and lawfully used". An unused visa arguably does not count, though no official text says so directly.
Can I apply for a new visa while the old one is still valid?
Yes, but the new visa has to complement the current one rather than overlap it.
Does withdrawing count against me?
A withdrawn application ends without a decision. Even a past refusal does not mean an automatic refusal under Article 21(9).
Can I extend my stay once inside Schengen?
Only for force majeure, humanitarian or serious personal reasons under Article 33, in the country where you are.
Can Visarun speed up a decision?
No. Missions such as Italy's consulate in London say processing cannot be rushed. Visarun helps prepare and check the file and new bookings, without guarantees on timing or outcome.
