Can You Travel to India on H-1B Without a Valid Stamp? (Quick Answer)
Yes, you can leave the US with an expired H-1B or H-4 stamp, and an expired stamp is not expired status. The State Department explains that CBP sets your authorized stay at each entry, and your I-94 records it.
The return is the problem: under INA 212(a)(7)(B), a nonimmigrant without a valid visa at admission is inadmissible, so you need a new stamp in India first.
Automatic visa revalidation covers only trips of 30 days or less to Canada, Mexico or, for F and J holders, adjacent islands. A trip to India never qualifies.
Check pending petitions first:
- H-1B extension pending: an archived USCIS FAQ says leaving generally does not cause a denial, and the approval can be sent to your consulate.
- Change of status to H-1B pending (for example, from F-1 OPT): leaving abandons it; any approval comes as a consular notification without H-1B status.
For petitions filed from 21 September 2025, USCIS says the $100,000 payment applies to consular notification or an abandoned change of status, although a federal court vacated that guidance on 8 June 2026 and the First Circuit denied a stay on 24 July 2026. Ask your employer's attorney before leaving.
For existing holders, USCIS guidance on the 2025 proclamation, not revised for the 2026 extension by 14 October, exempts currently valid H-1B visas and petitions submitted before 21 September 2025. The bigger risk is time: according to applicant reports on Reddit in September and October 2026, some H-1B workers skip a parent's funeral for fear of being stuck in India; in October, one whose mother had died there asked for any slot.
Emergency Appointment Requests in India - Who Qualifies
An emergency appointment is a request, not an entitlement. The State Department says consular sections may expedite an interview for an urgent, unforeseen situation "such as a funeral, medical emergency, or school start date", and that proof of the need is required.
Those examples describe urgent travel to the US. No official text says a death in India qualifies for the return trip; US Mission India decides case by case. We could not locate an official Mission India list of emergency criteria and evidence for 2026.
Weddings do not qualify. The State Department's note excludes weddings, graduation ceremonies, assisting pregnant relatives, annual conferences and last-minute tourism. According to applicant reports on Reddit in October 2026, a couple with no H-1B slot before their January wedding in India asked whether the invitation would help. Under that note, it would not.
How the request works
- Submit the DS-160, pay the fee and book the first available regular appointment. Only then is an expedite considered.
- Request it through the Mission's online appointment system. Email requests are not accepted.
- Approval comes by email with instructions; no answer means the request is still under consideration.
- Keep the existing appointment until the expedite is approved.
Mission India says expedited slots are "very limited" and that it cannot accommodate all travellers before their planned dates. There is no paid shortcut for H-1B.
Immigration law firms reported in February 2026 a short booking window after approval, described as ten days, and mixed experience with second requests after a denial. Neither is a published rule.
According to applicant reports on Reddit in October 2026, one H-1B holder already in India got an emergency appointment approved with his employer's attorney, then had to book biometrics and the interview separately.
Documents for an Emergency Request
The request rests on proof of the urgent need. Mission India's own evidence list could not be verified.
- For the request: official documents showing what happened, to whom and when. Lawyers recommended in February 2026 a clear explanation in the request text box, a brief supporting letter and, where relevant, an employer letter on the urgent business loss. They called medical emergencies generally the most persuasive ground.
- For the interview: a passport valid at least six months beyond your stay, the DS-160 confirmation page, the fee receipt, a photo uploaded with the DS-160, and the receipt number from Form I-129 or I-797. Officers may ask for more.
Mission India also instructs H-1B applicants and H-4 dependants to set all social media accounts to "public".
The Mission's help desk uses a non-.gov address on its scheduling platform, while the State Department calls non-.gov visa emails suspect. Use only the address printed on the Mission's website.
Visarun helps to prepare and check the DS-160 and the emergency explanation. The Mission decides, and no agency can promise a slot.
Third-Country Stamping and Its Limits in 2026
Stamping in another country is not a reliable plan in 2026. State Department guidance updated on 15 July 2026 says applicants should interview in their country of nationality or residence. Elsewhere it may be harder to qualify, fees are not refunded or transferred, and waits are expected to be significantly longer.
The listed exceptions do not include H-1B or H-4. "Rare exceptions" may be made for humanitarian or medical emergencies, but no procedure is published, so we do not treat it as a route.
The dropbox closed for H-1B and H-4 on 1 October 2025; waivers now cover mainly diplomatic and official visas and B1/B2 or H-2A renewals within 12 months. As a medical accommodation, Mission India waives interviews only in extreme situations, such as needing an air ambulance.
H-4 Spouses and Children - Separate Applications
H-4 family members can apply on their own. Under 9 FAM 402.10-14, a spouse and children may be classified H-4 when following to join the principal. They are not listed on the petition and generally get the same validity and admission period.
The officer needs to be satisfied that the principal is maintaining H status, which is possible without a valid visa after an extension inside the US. So an H-4 can be stamped in India while the H-1B stays in the US.
H-4 dependants qualify on the genuine relationship, without showing a residence abroad. We found no official India checklist; families typically carry the principal's I-797, proof of employment and marriage or birth certificates.
- Pending I-539 to change status: USCIS says it is generally treated as abandoned if the applicant leaves before a decision. For a pending H-4 extension, no official rule was found, so ask the employer's attorney.
- Short visit: the FAM allows a valid B-1/B-2 visa instead of H-4 if visitor rules are met, but CBP decides admission and the trip has to be genuinely temporary.
According to applicant reports on Reddit in October 2026, one husband does not expect an H-4 interview for his wife and their child under two before 2027.
Administrative Processing (221(g)) Risk
An interview can still end without a visa. A 221(g) refusal means the officer lacked information: documents are missing or administrative processing is needed. You have one year to submit what was requested; after that, you reapply and pay again.
Processing length varies by case. The State Department asks applicants to wait 180 days before inquiring, except for emergency travel involving serious illness, injury or death in the immediate family, and to report any unique hardship to the consular section.
The State Department's 18 September 2026 update lists H-1B and H-4 applicants under online presence review. University and law-firm notices dated the start to 15 December 2025, a date the official page does not show.
According to applicant reports on Reddit in October 2026, results after emailing social media handles ranged from approval the next day for a Hyderabad couple to no decision by 9 October for an H-4 applicant refused on 29 July.
Planning the Return - Job, Start Dates and Timelines
Plan for weeks to months in India. The State Department's forecast for petition-based visas, dated 17 September 2026 and unchanged when checked on 14 October:
- New Delhi — 3 months
- Mumbai — 1.5 months
- Chennai — 1.5 months
- Hyderabad — 5.5 months
- Kolkata — 1 month
These are predictions updated monthly, not open slots. Posts release extra slots regularly, so check back for earlier dates after booking. According to applicant reports on Reddit in October 2026, one Delhi applicant has biometrics on 27 November and the interview on 17 December, both in Hyderabad.
Closed dates, rest of 2026
- All posts in India, all visa services including 221(g): 28 October, 18 November and 16 December.
- New Delhi, Mumbai and Hyderabad: 20 October; Chennai: 19 October.
- New Delhi, Mumbai, Chennai and Hyderabad: 11 November, 26 November and 25 December; New Delhi and Mumbai also 24 November.
Before you fly
- Talk to your employer and its attorney about pending petitions and your role while abroad. No official guidance on remote work from India was found; according to applicant reports on Reddit in October 2026, at least one employer does not allow it.
- Avoid fixed return tickets: the State Department advises against final travel plans until the visa is issued, and CBP still decides admission.
- Days abroad beyond 24 hours can be recaptured toward the six-year H-1B limit if the employer requests it with travel evidence.
Recent Changes (2025-2026)
- 1 October 2025: interview waivers ended for H-1B and H-4.
- December 2025: according to a law firm alert, posts in India moved H-1B and H-4 interviews from 8 December, and a Mission post on X warned that arriving on the old date meant being denied admittance.
- June-July 2026: a court vacated the $100,000 payment guidance and the appeals court denied a stay; DHS still plans to collect if the order is lifted.
- 18 September 2026: Proclamation 11069 extends the 2025 H-1B entry restriction to 21 September 2027. Entry as an H-1B is restricted unless the petition is accompanied or supplemented by the $100,000 payment, and the text now covers admission to effectuate an approval, including via consular notification. As of 14 October 2026, no implementing USCIS or State Department guidance was found.
- 18 September 2026: Executive Order 14431 tells agencies to weigh an employer's past or planned layoffs in LCAs, petitions, visas and entry.
- Through 31 December 2026: a $750 expedite pilot for B visas only, at Mission Canada, Mission Mexico, Bogota, Guatemala City, San Jose and Tegucigalpa. No Indian post.
FAQ
Has my H-1B status ended if my visa stamp expired?
No. The stamp governs travel to a US port of entry. Your authorized stay is set by CBP and shown on your I-94.
Can I return from India on an expired stamp after a short trip?
No. A valid visa is needed at admission, and automatic revalidation covers only trips of up to 30 days to Canada or Mexico.
Does a parent's death in India qualify for an emergency appointment?
Not automatically. Funerals and medical emergencies are State Department examples for travel to the US. Mission India decides case by case, requires proof and says slots are very limited.
Can I get an emergency appointment for my wedding in India?
No. The State Department explicitly excludes weddings and recommends booking a regular appointment well in advance.
Do I need a regular appointment before an emergency request?
Yes. The DS-160, the fee and a confirmed regular interview come first. Keep that date until the expedite is approved by email.
Can I use the dropbox or stamp in another country?
The dropbox closed for H-1B and H-4 on 1 October 2025. Applicants are now expected to apply in their country of nationality or residence, with only rare humanitarian or medical exceptions.
Can my H-4 spouse get stamped in India without me?
Yes. An H-4 can apply to follow to join a principal who stays in the US, if the officer is satisfied the principal is maintaining H status.
What if I get a 221(g) refusal in India?
You have one year to submit what was requested. For serious illness, injury or death in the immediate family, the 180-day wait before inquiring does not apply.
